MUMBAI: Relaxation of eligibility criteria cannot be claimed as a matter of right, the Bombay HC held on Wednesday as it dismissed a PIL that challenged an eligibility requirement of 75% in the qualifying Class 12 board exams for IIT aspirants and sought its relaxation.
The HC said the cut-off criteria are not arbitrary.
“Whether relaxation is to be extended or not is in the realm of policy decision of the government,” said the HC bench of Acting Chief Justice SV Gangapurwala and Justice S V Marne.
The PIL was filed by activist-lawyer Anubha Sahai (44) who sought that continuation of an extension of the relaxation that was given for the last three years on the 75% cut-off criteria, which was done due to the Covid-19 pandemic.
The JEE helps students secure admission to IITs, NIIT, among others.
The HC added, “Merely because relaxation in criteria of minimum 75% marks in 12th Std was granted in the previous 3 admission processes, (it) would not entitle the students to continue to claim relaxation indefinitely.”
