JOHNSTOWN, Pa. – Charges have been dropped against an alleged suspect in a June 21 shooting that wounded two people in the West End of Johnstown, according to authorities.
Terrel Irving, 33, of Johnstown, faced several charges, including counts of felony aggravated assault, for his alleged role in the shooting in the area of Corinne Street.
However, during a preliminary hearing, witnesses to the incident did not appear in court to identify Irving, Cambria County District Attorney Greg Neugebauer said. Without that, it was difficult to move forward.
“We are able to file those (charges) in the future if we are able to get what we need,” Neugebauer said. “We are working towards being able to do that.”
Irving had faced four felony counts of aggravated assault; two felony firearms violations; and misdemeanor counts of terroristic threats, possessing an instrument of crime and recklessly endangering another person, according to court documents.
All have been withdrawn and the court docket closed, records show.
The people who were injured had non-life-threatening wounds, authorities have said. A person with a leg wound was transported to Conemaugh Memorial Medical Center for treatment, and a person with an arm injury fled the scene but arrived at the hospital later.
Neugebauer described withdrawing charges against Irving as the “proper course of action” in order to preserve the opportunity to file again in the future.
