The man facing the death penalty for killing a Hamilton County sheriff’s deputy did not give a statement to investigators after he was arrested, prosecutors said.

Among the issues discussed was the numerous motions that have already been filed by Hinton’s attorneys − including a motion to suppress Hinton’s statement to police.

Judge Jody Luebbers asked Hamilton County Assistant Prosecutor Kip Guinan if Hinton even gave a statement to police.

“Not as far as I know,” Guinan responded.

Hinton, 38, is now being represented by a second attorney, James Bogen, who was appointed to the case by Judge Jody Luebbers. Bogen will assist Clyde Bennett II, who was hired by Hinton and his family.

Prosecutors say Hinton intentionally drove his car into Deputy Larry Henderson on May 2 as the officer was handling traffic control for a University of Cincinnati graduation ceremony.

Bennett has previously indicated that he will pursue an insanity defense for Hinton, who Bennett said was not in his right mind that day. Hours before the incident, Hinton and other family members had been shown body camera video of Hinton’s son being fatally shot by a Cincinnati police officer.

Hinton’s trial is scheduled for Jan. 12, 2026. The next pretrial hearing is set for July 9.
