A Canandaigua man will avoid jail time after pleading guilty to third-degree assault for his role in a brutal dog attack in Downtown Canandaigua last August that left three people, including a child, injured.
Casey Murphy, 28, was sentenced to three years of probation after he was charged alongside Madison Herendeen for allegedly recklessly allowing Herendeen’s dog, a pitbull named Tito, to escape, resulting in the attack. According to police, the dog ran down the sidewalk and attacked a 10-year-old boy before also attacking and injuring the boy’s father and a bystander who tried to intervene on the sidewalk near South Main and Coy streets.
The boy suffered large lacerations on his back; the father suffered large lacerations and disfigurement on his back and arms, police said.
Murphy pleaded guilty to his charge back in May. Along with three years of probation, Murphy was also sentenced to 250 hours of community service, $7,543.60 in restitution and orders of protection were issued for the victims, according to prosecutors.
Herendeen has not changed her non-guilty plea and is scheduled for trial in the fall of 2025.
