BROCKTON — A Brockton man accused of stabbing a victim in the head and neck area multiple times at a residence in West Bridgewater in May could be released from custody as of Tuesday, Sept. 9.
A judge ordered Mario Raul Babbs, 38, of Brockton, to be held on a $10,000 cash bail in Brockton District Court Tuesday after prosecutors moved to postpone his probable cause hearing for a third time — exceeding the 120-day period a defendant in district court can be held without bail without probable cause, according to state law.
Babbs, who was deemed a danger to the community in May, has been held without bail since his arrest on May 8 on charges of attempted murder, assault and battery with a dangerous weapon and assault and battery, according to court records.
After prosecutors requested Babbs’ hearing Tuesday be postponed for a third time, which would exceed the 120-day period, Judge Paula J. Clifford imposed conditions of release.

Judge imposes harsher bail due to ‘severity of alleged crimes’
The prosecution and defense asked Clifford to impose a $2,500 cash bail, which she rejected Tuesday, claiming the severity of the alleged charges and Babbs’ criminal history warranted a $10,000 cash bail.
According to defense attorney Frank Spillane, his client did not have the funds to pay the originally requested bail of $2,500.
If Babbs does post bail, conditions of his release will include home confinement with GPS monitoring and staying away from and not contacting the alleged victim.

What caused the delay?
Assistant District Attorney Taramarie Pellerin said the prosecution is still waiting on records from Boston Medical Center South, formerly known as Good Samaritan Medical Center, which caused the delay.
Babbs’ probable cause hearing was rescheduled to Oct. 9.

West Bridgewater stabbing: What happened inside Spring St. residence?
At a West Bridgewater residence on Spring Street the night of Thursday, March 8, Babbs allegedly burst into a room occupied by a female witness and the male victim, and stabbed the victim multiple times in the head and neck area.
Two other witnesses at the scene, one male and one female, corroborated the original witnesses’ account of the incident, police said.
At Boston Medical Center South in Brockton, the victim told police he and Babbs ended up on the ground in the bedroom, where Babbs got on top of him and began stabbing him, according to the police report.
The victim, who had multiple lacerations on his head and neck area, survived the attack.
At the same hospital, Babbs, who was in custody and handcuffed to a bed, told police he had been awake for days getting high and that he had no recollection of stabbing the victim, according to the report.
