Need to catch some shut-eye in your car? Avoid the beaches.
In Lewes, Rehoboth Beach, Dewey Beach, Bethany Beach and Fenwick Island, it is illegal to sleep overnight in your car. Bethany is the only beach town that allows a daytime siesta, as the town’s car sleeping ban applies from 10 p.m. to 8 a.m.
Inland in Sussex County, you can find similar restrictions. Georgetown does not allow sleeping in your car. In Milton, the law says you can’t even pretend to sleep. You could face a $50 to $200 fine for this kind of snoozing.
If you’re stopped at the Biden Welcome Center on I-95 near Newark, no rules prevent parking there and sleeping as long as you want. At the Smyrna rest stop on Route 1, you’re allowed to stay up to six hours in a car and up to 10 hours in a truck or recreational vehicle. There is no statewide law against sleeping in your car.
In New Castle County, you are good to sleep in your car. Also, there are no laws against it in Dover or Kent County.
