Emergency response teams arrest man for threats against family

Apr. 15—SUPERIOR — A Wisconsin man who allegedly made threats to harm a Superior woman and her children, leading to a response from two law enforcement emergency response teams, made his initial appearance in Douglas County Circuit Court on Tuesday, April 15.

Sergio Montrell Roby, 39, of Altoona, faces one count of domestic felony intimidation of a victim; three counts of felony bail jumping; and misdemeanor counts of domestic threatening injury or harm via computer message, disorderly conduct and domestic disorderly conduct. All of the charges carry the repeater enhancer.

A cash bond of $15,000 was set for Roby, and he was ordered to have no contact with the woman, her children or their residence.

Roby’s ex-wife reported to Superior Police at approximately 8:36 p.m. Monday, April 14, that he had been calling and texting her at work threatening to harm her and their children, according to the criminal complaint. At the time, he was alone with their children in the woman’s home. Roby had recently been staying at the residence but had been asked to move out, the woman reported.

A perimeter was set up around the residence and the Superior Police Department’s Emergency Response Team and the Douglas County Sheriff’s Office Emergency Response Team both responded. Roby meanwhile continued sending threatening messages to his ex-wife, the complaint said.

Roby reportedly re-locked a back door when officers made a first attempt to enter the residence. When officers gained entry they found Roby sitting on the couch with a baby in his lap. While officers held Roby at gunpoint, a state trooper grabbed the infant and deputies helped secure the other children, the complaint said.

Roby was arrested and taken to the Douglas County Jail.

Roby has three open criminal cases in Eau Claire County Circuit Court, which include counts of felony bail jumping and felony contact after domestic abuse arrest, according to online court records. In 2021 he was convicted of armed robbery and being a felon in possession of a firearm, both as a repeater, in Eau Claire County.

The most serious new charge, repeater domestic felony intimidation of a victim, carries a maximum penalty of 10 years of imprisonment and a fine of up to $25,000. Due to Roby’s previous convictions, a judge could sentence him to an additional two years if convicted. His next court appearance in Douglas County was set for Tuesday, April 22. His next court appearance in Eau Claire County is Wednesday, April 16.
