Aug. 27—MITCHELL — A 20-year-old Mitchell man entered a not guilty plea Tuesday, Aug. 27, in Davison County Felony Court to a Class 3 felony charge of fourth-degree rape.
If convicted, the Lewis Leflore faces up to 15 years in prison and/or a $30,000 fine.
According to court documents, the incident was reported on the morning of Aug. 1, 2025. Officers with the Mitchell Police Department responded around 11:20 a.m. after receiving a call reporting a rape. The reporting party advised dispatchers that the suspect was still inside the residence.
When police arrived, the female victim told officers she was asleep in her bedroom and woke to Leflore engaging in sexual intercourse with her. The victim said she immediately confronted him, yelling at him to stop. Leflore allegedly threw a blanket over the victim’s face before fleeing into a bathroom.
Investigators recovered several of the suspect’s clothing items, including a sweatshirt, shoes, and a hat, from the victim’s bedroom, according to court documents. When questioned by police, Leflore neither confirmed nor denied having sex with the victim.
A witness at the residence also spoke with officers, stating that the night prior to the incident, Leflore had made unusual comments about wanting to have sex with the victim. The witness told him the victim was already in a relationship and would not be interested.
A jury trial has been scheduled for December.
