Apr. 18—ROCHESTER — Charleys Philly Steaks has been evicted from the Apache Mall after failing to pay rent and other fees, according to a court agreement filed this week in Olmsted County District Court.
According to an eviction settlement filed on Wednesday, April 16, the restaurant has agreed to vacate the mall by no later than 11:59 p.m. on May 5, 2025. The agreement requires Charleys ownership/management to turn over any keys to the Apache Mall. Mall ownership can still pursue any fees, charges or other costs associated with the lease.
The Apache Mall ownership, which is based in Delaware, filed an 86-page eviction complaint on March 7, against Charleys. The complaint alleged that Charleys owed more than $153,000 in rent and other fees. Rent was $6,510.25 per month — or more than $78,000 a year, according to the complaint. The restaurant was also required to pay other fees.
The complaint also shows a letter sent to Charleys in October outlining that, at that time, the restaurant owed more than $130,000 in rent and other fees.
Charleys Philly Steaks has been located in the Apache Mall since 2016.
